SPEAK THE TRUTH

It is not a suggestion it is the law. Attorneys on both "sides" are considered officers of the Court and owe a moral and legal obligation to the Court to prevent the Judge, who is only human, from making a material mistake of fact. The obligation to correct a Judge from making a faulty finding of fact overrides any obligation to win. Making a conscious decision to allow a Judge to base a ruling on a clearly erroneous finding of fact may well be the basis for an appeal. Our Supreme Court abhors not only the blatant waste of resources but the ethical violation by those who are obliged to "do justice" in lieu of winning at all costs. To "do justice" means to assure the facts are accurate.
